The EU Whistleblower Directive (Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law) aims to protect individuals who report breaches.
Companies should take this opportunity to review and improve their Whistleblower Systems. In Austria, the directive has been implemented through the Whistleblower Protection Act (HschG) (Published on 24.2.2023 in BGBl I No. 6/2023).
Who is affected?
Companies (legal entities) with 50 or more employees must comply with the provisions of the Whistleblower Protection Act (Not sole proprietorships). For commercial asset managers, a separate assessment may be necessary.
What are the main obligations? Protection of the whistleblower’s identity?
The main obligation under the HschG is to protect the identity of whistleblowers (confidentiality).
How to fulfill the obligations? Internal reporting system - Whistleblower System
Affected companies must establish an internal reporting system to protect the identity of whistleblowers. Offline and online solutions, a box, etc. Third parties, such as lawyers, can also be commissioned to operate a reporting system. The advantage of this is that training and the introduction of software, for example, can be dispensed with.
What are the consequences of violating the HschG? Up to EUR 40,000 administrative fine
Disclosing the identity of the whistleblower – violating confidentiality – is punished with an administrative fine of up to EUR 40,000. The disclosure of the report occurs when the whistleblower submits the report uncontrollably – for example, due to the absence of an internal reporting system or other organizational measures (violation of confidentiality). This is a risk for companies that needs to be managed. It is no help that the absence of a whistleblowing system cannot be punished under the Whistleblower Protection Act. The penalty provisions indirectly force the introduction of a whistleblowing system.
What is Best Practice? Managed Whistleblower System as the best protection!
The easiest and safest way is a managed internal reporting system. It usually involves the least effort and the lowest risk. If you do not establish an internal reporting system, you lose control over the incident, as in such a case, the whistleblower may contact external bodies and authorities.

- Choose your plan and monthly costs for your internal reporting system.
- We will contact you and support you in publishing your internal reporting system. You provide us with a contact person whom we can contact if necessary.
- Austrian lawyers monitor your internal reporting system and provide recommendations for further processing of reports.
Practically, you will receive a reporting link that you can publish on your website or intranet. You can send the link via email to your employees or publish a QR code on the bulletin board. At the same time, you will also have access to our platform.
Who can be an internal contact person?
We recommend the business owner or a member of the management team.
However, any employee who is appropriately trained (legal department, HR, etc.) can also be the internal contact person.
What does the UNOY Whistleblower System cost, and what do I get for it?
- Monthly costs and costs for initial qualification and recommendations must be distinguished.
- With EUR 0 monthly costs, we have the most competitive offer compared to other providers.
- For each report, EUR 150 per initial qualification is charged. There are no monthly costs for ongoing monitoring.
- In the other plans, the monthly flat rates for monitoring – starting at EUR 49 net – also include the specified number of initial qualifications.
- Each additional initial qualification is charged at EUR 150. Unused monthly processing will not be carried forward and will expire.
- A better ROI cannot be achieved, especially when considering the savings in internal effort.
- The costs for follow-up measures are to be agreed upon afterward. The lawyers’ activity for each report ends with the initial qualification and recommendation of follow-up measures.
- The monitoring activity ends with the end of the contractual relationship.
- The costs are charged annually.
How long am I bound?
EUR 0 plans can be terminated by either party with one month’s notice to the end of the month. Annual plans can be terminated with three months’ notice to the end of a calendar year.
